Maryland Real Property § 8-203
After tenant vacates
On deposits held 6+ months
Maximum Deposit Amount
Maryland caps security deposits at 2 months' rent for residential properties. This cap includes any pet deposits or additional security deposits. Non-refundable fees (like application fees or non-refundable pet fees) are separate and don't count toward this limit.
Escrow Account Requirements
Landlords must deposit security funds in an escrow account at a federally insured financial institution located in Maryland. The account must be separate from the landlord's personal or business funds. Landlords must provide written notice to tenants including the bank name and address within 30 days of receiving the deposit.
Interest Requirements
Maryland requires landlords to pay interest on security deposits held for 6 months or longer. The interest rate is set annually by the Maryland Department of Labor (typically around 3% simple interest). Interest must be paid when returning the deposit or credited against rent at the end of each 6-month period.
Refund Timeline
Landlords have 45 days after the tenant vacates and returns keys to return the security deposit or provide an itemized statement of deductions. Failure to comply may result in forfeiture of the right to withhold any portion of the deposit.
